1. Use of the Platform

1. You agree to use the Platform solely for lawful purposes and in accordance with these Terms.
2. You confirm that you are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
3. We reserve the right to suspend, restrict, or terminate your access to the Platform for violations of these Terms, security concerns, regulatory compliance requirements, or other operational reasons.

2. No Professional Advice & No Liability for Inaccuracies

1. The Platform generates AI-driven content, insights, analysis, and outputs (“AI Output”).
2. AI Output may, on occasion, be incomplete, inaccurate, outdated, or incorrect.
3. Velawx does not provide legal, financial, accounting, medical, investment, or other professional advice, and AI Output should not be treated as a substitute for advice from a qualified professional.
4. You agree that Kastech and its representatives shall not be liable for any reliance placed on AI Output, and that use of the Platform is entirely at your own risk.
5. AI Output may contain “AI hallucinations” or fabricated information. You are responsible for independently verifying all generated content before relying on or using it.

3. User Responsibilities

1. You shall not misuse the Platform or upload content that is illegal, infringing, harmful, or otherwise inappropriate.
2. You are solely responsible for verifying the accuracy and suitability of AI Output before relying on it.
3. You shall not use the Platform to train, develop, or improve any competing AI system.
4. You are responsible for maintaining the confidentiality of your account credentials.
5. Kastech shall not be liable for unauthorized access to your account resulting from weak or compromised passwords.
6. You must promptly report any suspected security breach relating to your account to our support team.

4. Intellectual Property Rights

1. All rights, title, and interest in the Platform - including its software, algorithms, trademarks, models, designs, content, and infrastructure - belong to Kastech.
2. You are granted a limited, non-exclusive, non-transferable, and revocable licence to use the Platform in accordance with these Terms.
3. You shall not reverse engineer, scrape, reproduce, copy, or attempt to extract the source code or underlying components of the Platform.

5. Limitation of Liability

1. To the fullest extent permitted by law, Kastech and its representatives shall not be liable for:
   1. inaccuracies or omissions in AI Output;
   2. loss of revenue, data, profits, business, goodwill, or opportunities;
   3. indirect, consequential, special, or exemplary damages; or
   4. service interruptions, technical failures, or unavailability of the Platform.
2. The total aggregate liability of Kastech under these Terms shall not exceed INR 1,000.

6. Payment

1. Access to certain features of the Platform may require a subscription or usage-based payment.
2. All applicable taxes, including GST, shall be borne by the User.
3. You must provide accurate payment information and authorize us to process payments accordingly.
4. Paid subscriptions may renew automatically unless cancelled before the renewal date.
5. Subscription cancellations remain effective until the end of the current billing cycle.
6. Fees paid are generally non-refundable, except where required by applicable law.
7. Initiating an unauthorized chargeback may constitute a breach of these Terms.
8. We reserve the right to revise our pricing and subscription structures from time to time.

7. Third-Party Services

The Platform may integrate with third-party APIs, AI providers, payment gateways, and other external services. We are not responsible for the actions, policies, security practices, or availability of these third parties.

8. User Content

1. You retain ownership of all content and materials you upload to the Platform.
2. By using the Platform, you grant us a limited licence to host, process, and use your content solely for the purpose of providing and improving Platform functionality.

9. Indemnity

You agree to indemnify and hold harmless Kastech, its affiliates, employees, officers, and partners from and against any claims, losses, or liabilities arising from your misuse of the Platform or your violation of these Terms.

10. Modifications

We may revise these Terms at any time. Continued use of the Platform after such changes take effect constitutes your acceptance of the updated Terms.

11. Nature of Service & Consumer Disclaimer

1. The Platform is provided on an “as-is” and “as-available” basis, as a technology-enabled AI facilitation tool.
2. We do not guarantee the accuracy, reliability, availability, legal validity, or business outcomes of AI Output or Platform use.
3. Mere dissatisfaction with AI Output or service results shall not, by itself, constitute a deficiency of service under applicable consumer protection laws.

12. Governing Law & Jurisdiction

1. These Terms are governed by the laws of India.
2. The courts located in New Delhi shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

13. Data Security & Confidentiality

Velawx maintains strict confidentiality standards as part of its legal document management practices.

1. All files are encrypted both during transmission and storage.
2. Access to your data is restricted to authorized users only.
3. Optional multi-factor authentication (MFA) is available for added account security.
4. We follow industry best practices for secure legal workflow management to protect sensitive case data.

14. AI Training & Data Usage

Velawx does not use client-uploaded case files for external AI training. Your data is processed solely to provide Platform services such as AI legal drafting, document review, and legal research tools. Outputs generated from your data are produced only for your use and remain confidential.

15. Force Majeure

Velawx shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, internet outages, or other force majeure circumstances.
